End User Terms of Service Agreement (‘Agreement’)

  1. The Agreement:

    This Agreement is between you and Jetstar Airways Pty Ltd (ABN 33 069 720 243) ("Jetstar"), and it governs your use of WiFi and internet services provided by Jetstar on Jetstar aircraft (the ‘Service’). Your use of the Service constitutes your acceptance of this Agreement. If you do not agree with these terms then you must not use the Service. Jetstar engages a third party service provider - Viasat, Inc. (“Third-Party Provider”) to provide parts of this Service to you including transaction related activities.


  2. Relevant laws
    1. Under consumer protection laws, including the Australian Consumer Law, certain statutory guarantees and warranties may apply to the supply of goods or services provided to you as a consumer. The nature and application of these guarantees or warranties will depend on the circumstances.
    2. Nothing in this Agreement excludes or restricts any applicable consumer protection laws, including the Australian Consumer Law, and these Terms will be read to the extent necessary to comply with any applicable laws including consumer protection laws.
    3. This Agreement is governed by and construed according to the law of the State of New South Wales, Australia and each party submits to the non-exclusive jurisdiction of the courts of that State.

  3. Privacy:
    1. Third-Party Provider will collect information about you and your use of the Service (including email address, the device type used, payment information when the Service is purchased on board the aircraft and complete browsing history) in order to:
      1. provide the Service on our behalf;
      2. improve the Service;
      3. receive payment from you to access the Service; and
      4. comply with applicable laws.
    2. For the reasons described above, your personal information collected by Third-Party Provider may be provided to Jetstar and/or our related companies, and other organisations which provide services to Jetstar, in order to comply with our legal obligations, including to various law enforcement agencies. Those parties may be located overseas including in the United States.

    Any use of your personal information by Jetstar or Third-Party Provider in connection with the service is subject to Jetstars Privacy Policy.


  4. Using the Service.

    In exchange for access to and use of the Service, you agree:

    1. to provide Jetstar (or where directed Third-Party Provider) with accurate registration information, if requested;
    2. to comply with applicable laws and regulations, including but not limited to copyright and intellectual property rights laws;
    3. to comply with any relevant requirements as detailed in Jetstar’s Conditions of Carriage; and
    4. Provide valid payment for this Service where required for your selected plan.

  5. Limits of the Service.

    The Service is subject to the availability and operational limitations of the requisite equipment, associated facilities and various external factors including acts of nature, technical failures or any other cause. You understand that:

    1. your connection and data rate speeds may vary and not be suitable for some applications;
    2. temporary interruptions of the Service may occur and that access may be intermittent or unavailable;
    3. the Service may be impacted by various matters beyond Jetstar’s control, including acts of God, satellite or other equipment failure, weather or solar occurrence, any law, order or regulation by any government, or other failures or delays caused by you or your equipment.
    4. The performance of this Service may also be affected by your own device, equipment, software or settings. We do not warrant that the Service will be compatible with your device and you are solely responsible for ensuring your device meets any required specifications for accessing and using the Service.
    5. Jetstar may suspend or restrict the Service at any time and for any reason, including for safety, operational, technical or regulatory reasons.

    Subject to your rights under the Australian Consumer Law and other relevant laws, Jetstar and Third-Party Provider are not responsible for any interruptions to the Service. Where such suspension or restrictions occurs for a material portion of the flight, and where you have made payment to purchase access to your selected plan, you may be eligible for a refund or credit in accordance with Jetstar’s applicable refund policy and/or your rights under any applicable laws including the Australian Consumer Law.


  6. General Use Restrictions.
    1. Voice or video calls will be prohibited through the Service.
    2. Jetstar may restrict access to certain sites that it deems harmful or inappropriate.
    3. Online activities may also be limited based on the specific Service plan you have purchased or with the plan included as part of your fare.
    4. Prohibited uses and activities include undertake any unlawful, fraudulent, or criminal purpose
    5. interfere with the ability of any other person to use or enjoy the Services, or engage in activities designed to degrade, or have the effect of degrading, service to Viasat users or others
    6. transmit unsolicited bulk or commercial messages or “spam;”

  7. Copyright Infringement

    Viasat is committed to complying with any applicable copyright and related laws, and requires all customers and users of the Service to comply with these laws. In accordance with applicable laws, it is Viasat’s policy to reserve the right to terminate the Service(s) of any user who infringes upon the intellectual property rights of another, including repeat infringers, or who Viasat believes, in its sole discretion acting reasonably, is infringing upon such rights.


  8. Third Party Content Disclaimer/ Links to Third Party Sites.

    Jetstar has no control over third party networks you may access in the course of your use of the Service, and therefore, delays and disruptions of other network transmissions are beyond Jetstar’s control. Content provided by third parties (‘Third Party Content’) has not been authenticated or approved by Jetstar even if we provide a link to such content. Jetstar does not make any warranty or representation, of any kind, regarding Third Party Content.


  9. Intellectual Property Rights
    1. Subject to your acceptance of and compliance with this Agreement, you are hereby granted a non-exclusive, non-transferable right to use the Service. The Service is provided for your personal use only and you agree not to reproduce, duplicate, copy, share, sublicense, transfer, sell or otherwise exploit the Service or access to the Service.
    2. All information, documents, products, and software (the ‘Materials’) provided with this Service are provided by Jetstar, Third-Party Provider Inc. or their respective manufacturers, authors, developers, licensees and vendors (‘Suppliers’) and are the copyrighted work of Jetstar or those Suppliers. Except as stated herein, none of the Materials may be copied, reproduced, resold, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, without the prior express written permission of Jetstar.

  10. Compliance with Laws.

    Your use of the Service is subject to applicable laws and regulations. You represent that you are not a prohibited end user under applicable U.S. export laws, regulations and lists.


  11. Disclaimer of Warranties and Liability. You acknowledge and agree that:
    1. Subject to your rights under the Australian Consumer Law and other relevant laws, and Clause 4 of this Agreement, Jetstar and Third-Party Provider are not responsible for any interruptions to the Service. your use of the Service is at your own risk;
    2. you are using a public internet connection and should take all precautions for the security of your device and information;
    3. you are solely responsible for any loss or damage to your device or to any information or other data that may result from your use of the Service, except to the extent such loss or damage is caused by the gross negligence of Jetstar; and
    4. there may be interruptions, delays, omissions, inaccuracies with the Service and that it may not be available at some times.

  12. General.
    1. This Agreement is governed by law of New South Wales, Australia and each party submits to the exclusive jurisdiction of the courts of that state.
    2. If any provision of this Agreement is found illegal, invalid or unenforceable, then illegality, invalidity or unenforceability shall not invalidate or render unenforceable any other provision of this Agreement and this Agreement shall continue in full force and effect and be construed as if it did not contain the illegal, invalid or unenforceable provision.
    3. The provisions of this Agreement which by their nature should continue shall survive any termination of this Agreement.

  13. Payments.
    1. In order to access the Service, you must either be eligible for access to a plan as part of your fare type or purchase a paid plan.
    2. Where access to a plan is via your fare type or you have purchased access to a plan prior to boarding your flight, Jetstar will provide you with the required information in order for you to access the Service.
    3. Where access to a plan is purchased onboard, charges are payable in Australian Dollars (AUD). Supported payment methods include selected major credit cards and selected digital wallets.
    4. Payments for plans onboard the aircraft are processed by Third-Party Provider Inc.
    5. Your card issuer or financial institution may charge foreign transaction fees, currency conversion fees, or other charges. These fees are not imposed by Jetstar or Third-Party Provider and are your responsibility

  14. Refunds.
    1. Refunds are provided in accordance with the Australian Consumer Law. Change of mind refunds are not available.
    2. Where you have purchased a plan, you may be eligible for a refund or credit where there is material impact to your Service, including circumstances where the Service is unavailable or significantly degraded for a material portion of the flight. Refund eligibility will be determined in accordance with Jetstar’s applicable refund processes and applicable consumer law.

  15. Plan Terms
    1. Different Plans provide for different inclusions such as levels of access, functionality, features and pricing – prior to purchasing a Plan, please read the product inclusions of the Plan to determine if the Plan meets your needs.
    2. All plans permit access from a single device at one time. Plan access may transferred to another device; however, this feature is only available to customers who purchase a Plan inflight and not be available to users with pre-authorised access (i.e. users who pre-purchase a Plan prior to boarding or who have a Plan included as part of their fare).
